I had a new client (Betty Lee Crocker) come into the office today and ask for some help putting together a simple will and other end-of-life documents. She is in her 50s and happily married to Benjamin Crocker. They live in Austin. They have two grown children who both live in Dallas (Cindy Crocker and Candy Crocker Tollhouse). Candy has two children. Cindy has never been married. Betty and Benjamin are both teachers and have a modest amount of savings and investments. Betty is putting together a list of their estate assets.
Betty would like her will to leave her entire estate (both personal and real property) to her husband upon her death (if he survives her by fourteen (14) days). If he does not survive her by fourteen (14) days, she would like to leave her estate to her children in equal shares (per stirpes) if any of them (or their descendants) survive her by fourteen (14) days. If none of her family survives her by fourteen (14) days, she would like to leave her estate to the Nature Conservancy. Her husband should be named as Independent Executor, followed by her daughter Cindy and then daughter Candy.
Please take a shot at drafting for me Mrs. Crocker’s will. When we discussed probate matters this week, I provided you with several example wills that should help to get you started – you should use the one with the “Example Will Provisions Based on Form Book” noted at the top as the go-by for your will. Please make sure you include the drafting considerations we went over in the office today, including that the will should be made self-proving. The document does not need to be double spaced, but should be styled neatly and easy to read (no need to use legalese).
