Overview

In order to meet their obligations to safeguard and defend both their national security interests and the online human rights of their citizens, particularly the rights to privacy and security, governments now have a challenging challenge. In order to overcome these obstacles, both public and private sector organizations must exercise their creative thinking.

This requires developing novel policy solutions, forming cross-sector alliances, and striking a careful balance between thwarting criminal activity and safeguarding civil liberties. The Cybersecurity Tech Accord and its members have been quick to support laws and programs that work toward these objectives and finding this balance, such the U.K.’s recent publication of their vulnerabilities “equities procedure.”

In the regrettable narrow pursuit of short-term national security advantages, other policy developments appear futile, have the potential to harm crucial alliances, and exacerbate cybersecurity issues. This includes enacting laws that restrict the freedom of speech and the right to privacy, like those recently passed in Egypt and Vietnam, as well as implementing procedures and practices that might erode the security of technological advancements, out of proportion to any hoped-for “national security” benefits. One such bill is the current Australian Assistance and Access Bill 2018.

The goal of the bill is to find ways to find and deal with illegal activity that is concealed by advanced technology like encrypted communications.
