Uniform System of Citation (21th ed.) to format all of your assigned and
produced citations. Remember to use the law review citation form (the white
pages), not the practitioner’s form.
Your citations should appear like citations in a law review article, rather
than those in a document submitted to a court.
You must save and
title this document by your anonymous identification number. For example, if
your anonymous identification number is “12345,” your submission file must be
saved as and titled “12345.” Your
anonymous identification number must also be included as a header on each page
you submit. Use number 2733
To the extent these
guidelines conflict with any other information you have received, these rules
are supreme.
What Is the Meaning of “Intervene” Under
the False Claims Act’s First to File Bar
This exercise
asks you to analyze and evaluate competing case law on a particular issue as if
you were writing an abbreviated note for a law journal. The form that a note
usually takes is to discuss the contesting approaches regarding the legal issue
and then reach a conclusion, advocating for the best approach.
The attached sources relate to the following
issue: What is the meaning of “intervene” in the context of the False Claims
Act’s first to file bar? The Supreme Court has not yet spoken on the issue, but
circuit courts have handed down conflicting opinions on the issue. You are
expected to advocate for a solution to this circuit split using the resources
provided.
Do not exceed six
(7) typed, double-spaced pages of text with 1-inch margins and 12-point Times
New Roman font. Do not exceed one (1) typed, double-spaced page for your introduction.
Do not exceed (1) typed, doubled-spaced page for your conclusion. ALL
CITATIONS SHOULD BE IN THE FORM OF ENDNOTES. Endnotes will not count toward the
page limit. Although your citations for Legal Research and Writing have
followed the “Bluepages” of the Bluebook (i.e. the pages at the beginning of
the book that are literally blue), your citations for this assignment must conform
to the “Rules” section of the Bluebook
(i.e. the white pages of the Bluebook).
Write a concise
Note that addresses the legal issue(s) as discussed in the following sources.
You may use as many or as few of these sources as necessary to successfully
complete the task, but you may not use sources that are not included in the
attached materials. Additionally, in compliance with the Honor Code, do not
discuss the sources or your note with any other individual, including those
outside of the Law School. If you feel they are relevant, you may also make
policy arguments in your note. Your Note must comply with all rules and
guidelines that are provided in the Write-On Materials. For the purposes of
this assignment, assume all the sources are good law.
