PROVIDE A RESPONSE TO THE DISCUSSION BELOW:
Explain your thoughts on this matter — should the U.S. Constitution be amended to specifically define a right to privacy or, do you feel that the holdings of the U.S. Supreme Court (and tell me which cases) are sufficient protection in this matter; why or why not? Is there perhaps a specific privacy right that you feel particularly strong about personally; explain. Make sure that you use specific examples and at least two resources to substantiate your opinion.
Should the actual U.S. Constitution be amended to specifically define a right to privacy, in my own opinion I would say no. Here is way, first of all the US Constitution is a foundation to our federal government which guarantees every American rights, protection of life, liberty and property. 3 Second, the Bill of Rights was created and used to make amendments to the US Constitution. So with the US Constitution being the foundation and the Bill of Rights used as a tool to amend the Constitution then I would just continue to make amendments.
Third when dealing with legal cases it is mentioned in the web article by ConstitutionUS.com that, “the US Supreme Court deliberately takes case-by-case approach because of the new ways that privacy becomes an issue.” As mentioned earlier I feel that as long as the Supreme Court continues to take a case by case approach then it should be sufficient enough to ensure the rights are still within the US Constitution.
One of the cases I think that is very important topic is the Reproductive Right. I am from Texas and as of September 1, 2021, according to the Texas Tribune, “Texas became one of the most restrictive abortion laws in the country.” During this time a woman was arrested and given a $500,000 bond for ending her pregnancy. Health News reports that a judge later dismissed the murder charge but image what the woman had to go through. So with this subject in reproductive rights, who am I to tell a woman what she can and can’t do with her body. I have sisters and a daughter and I still wouldn’t interfere with the decision they make, I would be supportive with whatever they decided.
I think the specific right that I feel strongly about is the Right to Privacy, and here is why. Over the last 18 years I have had the privilege of serving my country and have been in locations and saw first had of the luxuries we tend to take for granted. In the locations I have been in I have seen houses searched, cars, money, food, clothing, and people beaten in the streets.
During the Packer Corporation vs Utah Justice Brandies suggested the court consider the conditions under which privacy interests are intruded upon. The right to privacy is just that no one should be able to come into your home and tell you what to do.
Also around 1965, reported by Britannica, “is when the Supreme Court ruled that the federal Constitution included an implied right to privacy.” So as long as we the people have rights we can only hold those accountable to those standards. I understand nothing is perfect but I have seen people live in an environment with no rights whatsoever. So I hope we continue to make improvements for the future of society that impacts the greater good of all man kind.
