What is meant by “all evidence comes to the jury through the mouth of a witness”?
The outcome of a trial includes the jury’s decision based on evidence
presented and witness testimony. But, all evidence first faces scrutiny
from the prosecution, defense, and the judge on whether such evidence
will be admissible or inadmissible.
Rules of admissibility exist in: “The Federal Rules of Evidence, set by
Chief Justice Earl Warren in 1965 and made law by Congress in 1975”.
There are slight variations from state to state; yet, mostly concur with
the federal rules. And, according to John Fuller’s article, ensure
three criteria are met:
“Relevance…describes any piece of evidence related to the case”
“Materiality…needs to prove an essential fact of the case”
“Competence…an object or testimony proven to be reliable”
Therefore, after inadmissible evidence has been excluded, the admissible
evidence can now come to the jury through the mouth of a witness.
Determining the admissibility of evidence is important to allow
appropriate evidence and exclude inappropriate evidence regardless of
whether the evidence benefits the prosecution or defense. Also, the
determination of evidence allows both sides to consider whether or not
to proceed, seek dismissal, or plea bargain.
While evidence can both prove and disprove guilt, or cause enough doubt.
It is for the jury decide. But again, only properly submitted and
admitted evidence comes to the jury through the month of witnesses.
