CASE 1
For several years, the state of Rudonia’s armed forces have been fighting against the armed forces of Walali, a neighboring state. Members of both forces have been captured by the enemy and put in POW camps. You are a member of the ICRC and want to visit the POWs. When arriving at the camp of Rudonia, the head officer of the camp is refusing to allow you to visit the prisoners detained in the camp.
Please inform the officer about your right to visit the prisoners. That information must address the following issues (examined in the course):
the legal basis of such a right;
the conditions under which it may be exercised;
the potential restrictions to it and
its purposes.
CASE 2
The governmental forces of Uzukstan are fighting against an armed group operating within its borders, called the Revolutionary Movement of Uzuksan (RMU). The neighboring state, Jugustan, is involved in the military operations carried out by the RMU. It is known that members of this armed group have committed serious IHL violations. Is it possible for Uzukstan to invoke the responsibility of Jugustan?
Your answer must address the following issues (examined in the course):
the standard for attributing the IHL violations committed by the RMU to Jugustan;
the definition of that standard;
its legal basis;
two jurisdictional cases in which it has been discussed;
another standard from which it must be distinguished as it concerns the issue of qualification of armed conflicts;
the definition of that other standard in comparison to the former one and
one jurisdictional case in which it has been defined.
CASE 3
You are a member of the Belgian Ministry of Justice. A journalist, who wishes to gain an understanding of the system of international criminal justice, has approached the ministry. The journalist would like to know:
the common characteristics of the ad hoc international criminal tribunals;
the triggering mechanisms of the ICC jurisdiction and
the ICC jurisdictional bases.
In order to prepare for the interview, you write a memo listing the relevant elements (mentioned in the course) regarding these three issues.
