1. LO1: explain and apply the main principles of business, company and employment laws affecting company directors, entrepreneurs, managers and employers;
2. LO2: critically evaluate the operation of legal frameworks within which organisations operate, including particularly aspects of negligence, nuisance, agency and some criminal issues;
3. LO3: demonstrate skills of critical analysis of the law, including the logical application of law to the solution of legal problems likely to be encountered by an organisation.
4. LO4: demonstrate an ability to identify and use legal materials, including some primary sources.
Tasks
There are 4 different scenarios presented below.
To research and write 3,000 words on the questions and corresponding case studies which tackle all the potential legal issues arising from various scenarios.
Each response to the 4 scenarios is worth up to 25 marks from a total of 100 marks.
Case Scenario 1
Raj works as a mechanical engineer for GreenTech Innovations, a renewable energy firm based in Manchester. Raj was recently diagnosed with type 1 diabetes and informed his line manager about the condition. Despite providing medical documentation, Raj noticed that he was excluded from site visits and client-facing meetings following his disclosure. A recent promotion opportunity was given to a junior colleague with less experience. Raj believes this is due to his medical condition. In addition, he was recently mocked in a staff WhatsApp group for having “too many sugar breaks,” which was started and moderated by his line manager.
Question 1
Advise GreenTech Innovations on its legal obligations under employment law and the Equality Act 2010 in relation to Raj’s treatment, including issues of discrimination, harassment, and reasonable adjustments. Support your advice with relevant statute and case law.
Case Scenario 2
Layla, a 14-year-old girl, attends an amusement park owned by FunRealm Ltd with her friends. While walking between attractions, she slips on a puddle of water that had formed near a leaking drinks vending machine. There were no warning signs and no staff nearby. Layla suffers a broken wrist and mild concussion. Her parents are considering legal action against the park.
Question 2
Advise FunRealm Ltd on their duties under the Occupiers’ Liability Acts 1957 and 1984, and whether they could be liable for Layla’s injuries. Include in your discussion the issues around lawful visitors and potential contributory negligence.
Case Scenario 3
Maya works remotely for a graphic design agency. She signs a freelance contract with BrightPixel Ltd for a 6-month term, agreeing to deliver a set number of projects per month. Maya believes she is self-employed, as she invoices the company and pays her own tax. However, the company imposes strict working hours, approves all holidays, and forbids her from working for other clients. After three months, BrightPixel terminates the contract without notice, citing poor performance. Maya believes she should have had employee protections.
Question 3
Advise Maya on her potential employment status under UK law, and whether she may have rights to unfair dismissal or other protections. Reference key case law and statutory definitions of employee, worker, and self-employed status.
Case Scenario 4
Zane and Farrah decide to form a private company, EcoPod Homes Ltd, to manufacture sustainable housing pods. They recruit an investor, Oliver, who agrees to provide £200,000 in exchange for 25% of the company’s shares and a seat on the board. However, after signing the shareholder agreement, Zane uses company funds for personal expenses, including luxury holidays, without board approval. Farrah and Oliver want to remove Zane and recover the funds.
Question 4
(a) Discuss the legal mechanisms available to Farrah and Oliver to remove Zane from the board and reclaim misused company funds.
(b) Evaluate the duties and liabilities of directors under the Companies Act 2006.
(c) If Zane had not yet been formally appointed as a director but had acted as one, would he still be liable? Explain your reasoning with reference to law.

- show evidence of wider reading and research (relying on class materials will be insufficient)
- make specific reference to relevant statute and case law (the higher marks will be gained by again showing knowledge of examples beyond those introduced in the sessions i.e. see if you can find additional case law to reference)
- write clearly and articulately, showing that you fully understand the academic conventions. The ACE team will help you if you are at all unsure, but do not leave it until the last minute to seek support!

You will need a short and focused conclusion.

With a case study scenario remember the following:
(a) it is based on a factual scenario that could happen in real life
(b) demonstrate your understanding of a particular area or areas of law and apply them in a practical way to the problem. So, look at the issue and see what law/legal principle applies and use your knowledge of case law or statute to show the authority for that law or legal principle.
(c) work through all the relevant legal issues but remember not all of the issues will require in depth analysis. Sometimes the issue may seem trivial but look at it and if it doesn’t need exploring in detail you may need to explain why.
(d) Remember in law you need to argue both sides of a case and argue the likely success of those cases.
