The two most concerning ethical concerns impacting the BMI program I identified are lack of written consent from parents/guardians of participants and violations to FERPA or HIPAA.
Have the program administrators obtained informed consent from parents/guardians of participants? School-based intervention and prevention programs usually require consent for participation which can present a challenge for program participation (NLM, 2009). Failure to obtain consent could result in legal issues.
Does the program violate HIPAA or FERPA regulations? HIPAA is the Health Insurance Portability and Accountability Act and protects personally identifiable information (PII), or any type of sensitive information related to a patient from being disclosed without patient consent (CDC, 2018). Typically, HIPAA does not apply to schools but in cases where health care is provided to students, HIPAA must be considered (HIPAA Journal, 2020). In this case FERPA, The Family Educational Rights and Privacy Act may also be violated by the program. FERPA gives parents the authority over their children’s educational records (U.S. Department of Education). Since the BMI is appearing on the report cards, the educational record is impacted by the program and are therefore subject to FERPA privacy regulations.
Since my program is also school-based, I will have to carefully consider these two ethical issues. By obtaining parental/guardian consent prior to the program beginning, I think these potential problems can be avoided. It will also be important to consult with legal experts to review the program for any violations or potential issues with implementation plans.
