Without any doubt, the Coronavirus pandemic is unprecedented after the globalisation of the world. Governments across the globe have taken drastic measures (e.g., travel restrictions, lockdowns, quarantine, etc.) resulting in parties being unable to meet their contractual obligations.
This paper will analyse the implications of Force Majeure (how it differentiates from Undue Hardship or material adverse change – not in much detail) provisions on international contracts.
The paper will focus on English Laws and draws a comparison with US and Indian Law in common​‌‍‍‍‌‍‌‍‍‍‌‌‌‍‌‌‌‌‌‌​ law jurisdiction. And also look at countries in civil law such as the United Arab Emirates and one or two other civil law countries.
