I chose option 2 this week. Identify a recent decision by the U.S. Supreme Court and discuss the nature of the case and the basis of the argument the Supreme Court used to reach the decision. Explain why you agree or disagree with the ruling?
On September 1st, 2021, the “Texas Heartbeat Act” or SB 8 was passed in Texas. This law made it illegal in Texas to have an abortion after about 6 weeks (about 1 and a half months), which is around when the fetal heartbeat is detectable. The law also allows criminalization of any individual that aids or abets any abortions and allows private citizens to file a lawsuit against any person receiving an abortion or aiding in an abortion (Whole Woman’s Health v. Jackson, n.d.). This law was a direct violation of women’s constitutional right to have access to abortion before fetal viability that is established by Roe v. Wade. A fetus is considered viable after 24 weeks of gestation. On the same day that SB 8 was passed, the Supreme Court denied an emergency request to block Texas’s stringent new abortion law. On September 23, 2021, a petition for writ of certiorari before judgment was filed and granted by the Supreme Court on October 22, 2021 (Whole Woman’s health et al. v. Jackson et al., 2022). A writ of certiorari is one of the most powerful tools the Supreme Court has. It is where an appellate court (lower court) sends a case involving a constitutional issue, up to the Supreme Court for review (Greenberg & Page, 2020). On December 10, 2021, the Supreme Court, in a 5-4 decision ruled in favor of Jackson (Texas), it ruled that providers cannot sue state judges, clerks, or the Attorney General, on account of sovereign immunity. In essence, it upholds the SB 8 law, and allows private individuals in Texas to sue person’s receiving abortions, anyone one providing abortions or caring for a person receiving an abortion, including doctors, nurses, and even the people providing transportation (Whole Woman’s health et al. v. Jackson et al., 2022). It circumvents the constitution and puts the law into private individual’s hands by giving people the power to sue abortion clinics endlessly, which could force them to shut down due to the excessive cost of court. I disagree with the court’s ruling for a variety of reasons, the first one being that women should have the right to safe and affordable abortions before fetal viability without government involvement. The court made it okay for other states to adopt these stringent abortion laws at the cost of women’s lives. It is also in direct violation of Roe v. Wade, if the Supreme Court will not uphold the Constitution then who will?
